Terms of Use
These terms explain what you can expect from HeartBrain and what we ask of you. We have written them in plain English rather than legal language.
In short: use HeartBrain kindly and lawfully, and remember it is a tool for organising and understanding your situation, not a substitute for professional advice.

1.About these terms
These terms are the agreement between you and HeartBrain for use of our website, app and services. By creating an account or using HeartBrain you accept them. If you do not accept them, please do not use the service.
They work alongside our Privacy Policy, Cookie Policy and Community Guidelines.
2.HeartBrain does not give legal, medical or HR advice
This is the most important thing on this page. HeartBrain is a tool for organising your situation and finding support. It is not a law firm, a healthcare provider, or your employer's HR department.
- Content, templates, letters, scores, stage recommendations and AI output are general information only. They are not advice about your specific circumstances.
- AI can be wrong or incomplete. Always read anything it produces before you use it or send it to anyone.
- Employment claims have strict time limits. Do not rely on HeartBrain to calculate or protect a deadline. Take professional advice in good time.
- If you are in crisis or at risk of harm, contact emergency services or one of the organisations on our crisis support page.
3.HeartBrain Resolve and dispute intelligence
HeartBrain Resolve is our dispute intelligence service for employees and employers. It analyses UK employment law, official guidance and the documents you upload, and produces cited case assessments, procedural guidance and answers to your questions.
- HeartBrain is not a law firm and does not carry out reserved legal activities under the Legal Services Act 2007. Using Resolve does not create a solicitor-client relationship.
- Resolve provides dispute analysis and procedural guidance: legal information about your situation, not regulated legal advice tailored by a solicitor.
- Assessments are AI-generated from statute, ACAS guidance and your own documents. Every point is checked against its source, but you remain responsible for the decisions you take and for protecting your own deadlines.
- For formal representation, contact Acas (0300 123 1100) or one of our vetted partner solicitors, who can advise you in a regulated capacity.
4.Who can use HeartBrain
- You must be at least 16 years old and able to enter a contract.
- You must give accurate registration details and keep them up to date.
- One account per person. You are responsible for keeping your password safe and for everything done through your account.
- Tell us straight away at privacy@heartbrain.io if you think someone else has accessed your account.
5.Community conduct and moderation
The community only works because people treat each other well. You take part under a pseudonym, and the same is true of everyone else.
- Be respectful. No harassment, hate, threats, or targeting of individuals.
- Do not name or identify individual colleagues, managers or organisations in a way that could identify them.
- Do not post anything unlawful, defamatory, or that breaches someone else's rights.
- Do not post confidential documents belonging to your employer.
- No spam, advertising, or recruiting members for other services.
- Do not misuse Marka points, invites or votes, including through fake accounts.
We may edit, hide or remove content, and restrict or close accounts, where these terms or the Community Guidelines are broken. Where it is reasonable to do so, we will tell you why and give you a chance to respond.
6.Your content and ours
You keep ownership of everything you create on HeartBrain, including your posts, your Tracker records and your documents. You give us a licence to host, store, display and process that content only so we can provide the service to you, and to show your community posts to other members.
HeartBrain owns the platform itself, including the software, the HeartBrain and Marka names and branding, our artwork, our handbooks, our questionnaire and our templates. You may use them for your own situation, but not copy, resell or republish them commercially without our written permission.
7.Tracker subscriptions and payment
- Community, Library, Marka recognition and crisis support are free. Tracker is a paid subscription.
- Payments are taken by Stripe. Prices are shown before you buy and include VAT where it applies.
- Subscriptions renew automatically each period until you cancel. We tell you the renewal amount and date before we take it.
- You can cancel any time from your billing settings. Cancellation stops the next payment; you keep access until the end of the period you have paid for.
- You have a statutory 14 day right to change your mind on a new subscription. If you ask us to start immediately and then cancel within that period, we may charge for the part you used.
- If we change prices we will give you at least 30 days' notice before it affects you.
- Cancelling Tracker does not delete your data. Your records stay in your account.
8.Experts and introductions
HeartBrain introduces you to independent lawyers, counsellors and coaches. They are not employed by us.
- Any agreement for their services, including their fees and terms, is between you and them. We are not a party to it.
- Experts only see your information when you choose to share it, and only what you share.
- We check credentials when experts join our network, but we are not responsible for the advice they give or the outcome of their work.
- Payments to experts may be handled through the platform for convenience. Disputes about their work should be raised with them first, and with their regulator if needed. Tell us as well so we can review their place in the network.
9.Acceptable use
- Do not attempt to access another member's account, case or data.
- Do not scrape, copy in bulk, reverse engineer or interfere with the platform.
- Do not upload malware or anything designed to disrupt the service.
- Do not use HeartBrain to harass anyone, on or off the platform.
- Do not use the service unlawfully or to break someone else's rights.
10.Availability and changes to the service
We work hard to keep HeartBrain running, but we cannot promise it will always be available or error free. We may add, change or remove features, and we may carry out maintenance. Where a change materially reduces what you have paid for, we will tell you and you may cancel.
11.Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights as a consumer are not affected.
Subject to that, we are not liable for the outcome of any grievance, claim, tribunal or employment decision, for advice given by an independent expert, for content posted by other members, or for losses that were not reasonably foreseeable. Where we are liable, our total liability is limited to the fees you paid us in the 12 months before the claim.
12.Ending your account
You can delete your account at any time from Privacy & data. We may suspend or close an account that seriously or repeatedly breaks these terms, or where we must do so by law. If we close your account, we will refund any unused part of a subscription unless the closure was for serious misuse. What happens to your data afterwards is set out in our Privacy Policy.
13.General and contact
We may update these terms. The date at the top shows the current version, and we will tell you about significant changes. If any part of these terms is found to be unenforceable, the rest continues to apply.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may bring proceedings in your local courts.
Questions about these terms: privacy@heartbrain.io or the contact page.
